Quick answer: Property title search and verification
Before buying property, a title search typically traces the chain of ownership documents over about the last 30 years, checks encumbrances and mortgages, mutation and tax records, authority approvals and, for new projects, RERA registration. This helps uncover disputes, loans or defects in title before money is paid. Law Chambers of Mridul Jindal handles these matters in Ghaziabad, Noida and Delhi. Call +91-8800669834.
Verify the Title Before You Pay
Buying a flat, plot or shop is one of the biggest financial decisions most families make. In Delhi NCR, problems such as a broken chain of title, an undisclosed mortgage, unpaid authority dues, a family member's claim or a pending case often surface only after the money has been paid. A proper title search before you sign the agreement or pay the token amount is the simplest protection.
The Law Chambers of Mridul Jindal carries out title searches and legal due diligence for buyers, NRIs, investors and businesses purchasing property in Noida, Greater Noida, Ghaziabad and Delhi. You receive a written title search report setting out the chain of ownership, what we checked, the risks we found and what to fix before the deal proceeds.
For a do-it-yourself overview, see our property due diligence checklist for Noida and Ghaziabad.
What We Check
Chain of title: the sale deeds and other title documents going back over a long period (usually around 30 years, or to the original allotment), checking that each transfer was properly executed, stamped and registered.
Registered encumbrances: a search of registered documents at the Sub-Registrar office and, in UP, through IGRS records, together with a CERSAI search for mortgages and charges created in favour of banks.
Authority records (Noida, Greater Noida, YEIDA, GDA, DDA): most land in Noida and Greater Noida is leasehold from the development authority, so we check the lease deed, transfer memorandum, outstanding lease rent or dues and the authority's permissions. In Delhi, we check leasehold or freehold status and any conversion.
Revenue and municipal records: mutation, khatauni or property tax records, and for land or villa plots, the land-use and conversion status.
Litigation and insolvency: searches for pending suits, attachments, DRT recovery cases and, for builder projects, insolvency proceedings before the NCLT.
Builder projects: UP RERA registration, sanctioned plans, completion or occupancy certificate, and the builder-buyer agreement terms.
Common Red Flags
GPA or agreement-to-sell transfers: in Suraj Lamp & Industries v. State of Haryana (2011), the Supreme Court held that sales through a General Power of Attorney, an agreement to sell or a will do not transfer title to immovable property. Such properties need a properly registered conveyance before you buy.
Seller is not the sole owner: inherited property where other legal heirs have not relinquished their share, or a property owned jointly where only one co-owner is signing.
Unpaid dues and transfer charges: outstanding authority dues, maintenance arrears or transfer charges that can delay registration or fall on the buyer.
Existing mortgage: a home loan or business loan secured on the property, which must be closed and the charge released at or before registration.
For NRIs, Home Loans and What to Send Us
NRIs and buyers who cannot visit often can complete the entire verification online, and we coordinate with your family member or attorney-holder in India. Banks run their own legal checks for home loans, but those checks protect the bank. An independent title search protects you. See also our NRI legal services.
If a problem with title or possession has already arisen, see our property and real estate disputes page.
Documents to send: copies of the seller's title deeds and previous sale deeds, the allotment letter or lease deed (for authority land), the transfer memorandum if any, property tax and mutation records, the builder-buyer agreement and RERA details for builder projects, and the seller's identity documents.
Consultations are by prior appointment at our Indirapuram chamber or online. Please contact us before you pay any token or advance. This page is general information, not legal advice.
Frequently Asked Questions on Title Search
It is a written legal report on a property's ownership history and legal status. It traces the chain of title, records the searches carried out at the Sub-Registrar and other offices, and lists any encumbrances, disputes or defects, with recommendations before purchase.
Title is usually traced over about 30 years, or back to the original allotment for development-authority property. The exact period depends on the property and the purpose, such as a bank's requirements for a home loan.
A General Power of Attorney or agreement to sell does not transfer ownership, as the Supreme Court held in Suraj Lamp & Industries (2011). The seller should first obtain a registered sale deed in their own name.
The bank's legal check is done for the bank's protection and may be limited. An independent title search is done for you, covers your specific concerns, and is done before you pay the advance.
