How to Find the Right Court for Your Case
- FIR and criminal cases: the case is handled by the courts of the district in which the police station that registered the FIR falls. For example, an FIR at a Laxmi Nagar or Preet Vihar police station (East district) goes to Karkardooma, and one at a Saket or Malviya Nagar police station (South district) goes to Saket.
- Bail: regular and anticipatory bail are usually sought first in the Sessions Court of that district, and the Delhi High Court can also hear bail applications under Sections 482 and 483 of the BNSS.
- Cheque bounce: under Section 142(2) of the Negotiable Instruments Act, the complaint is filed where the payee's bank branch (where the cheque was presented for collection) is located.
- Civil suits: under Sections 16 to 20 of the CPC, a suit is filed where the defendant lives or works, where the cause of action arose, or, for property, where the property is situated. Suits valued above Rs 2 crore are filed on the original side of the Delhi High Court.
- Commercial disputes: disputes of Rs 3 lakh or more go to the Commercial Courts, after pre-institution mediation under Section 12A of the Commercial Courts Act unless urgent relief is needed.
- Divorce and family cases: under Section 19 of the Hindu Marriage Act, a petition can be filed where the marriage took place, where the respondent lives, where the couple last lived together, or where the wife lives if she is the petitioner.
Delhi or Uttar Pradesh? Cases Across the NCR Border
Delhi, Noida and Ghaziabad are close to each other but fall under different court systems. Cases in Delhi are heard by the Delhi district courts and the Delhi High Court. Cases in Noida (Gautam Buddh Nagar) and Ghaziabad are heard by their own district courts, and appeals and writs go to the Allahabad High Court. When related cases are pending in different places, for example a divorce in Delhi and a maintenance case in Ghaziabad, a transfer petition can be filed in the Supreme Court or the High Court.
Our chamber is in Indirapuram, close to the Karkardooma Courts, and we appear regularly in the Delhi district courts, the Delhi High Court and the Supreme Court, as well as the Ghaziabad and Noida courts.
