Quick answer: Bail in Delhi

In Delhi, anticipatory bail under Section 482 of the BNSS (earlier Section 438 CrPC) is usually filed first in the Sessions Court of the district where the FIR is registered, for example Karkardooma for East Delhi or Saket for South Delhi, and then in the Delhi High Court if needed. After arrest, regular bail is sought before the Magistrate under Section 480 or the Sessions Court and High Court under Section 483. If the charge-sheet is not filed within 60 or 90 days, default bail can be claimed under Section 187(3). Law Chambers of Mridul Jindal handles these matters in Delhi. Call +91-8800669834.

Where to File Bail in Delhi

The court depends on the police station that registered the FIR. Delhi's eleven judicial districts sit in seven court complexes: Tis Hazari (Central, West), Patiala House (New Delhi), Karkardooma (East, North-East, Shahdara), Rohini (North-West, North), Dwarka (South-West), Saket (South, South-East) and Rouse Avenue (special courts, including many CBI and ED cases). See our Delhi courts guide to find the right complex.

Anticipatory, Regular and Default Bail

  • Anticipatory bail: On a complaint, FIR or summons, with interim protection from arrest while the application is heard.
  • Regular bail: After arrest, before the Magistrate, Sessions Court or Delhi High Court depending on the offence.
  • Default bail: When the charge-sheet is delayed beyond 60 or 90 days, under Section 187(3) of the BNSS.
  • Undertrial release: Under Section 479 of the BNSS after half of the maximum sentence (one-third for a first-time offender).

Arrest Safeguards the Courts Apply

For offences punishable with up to seven years, the police should generally issue a notice of appearance under Section 35(3) of the BNSS instead of arresting, as directed in Arnesh Kumar v. State of Bihar (2014) and Satender Kumar Antil v. CBI (2022). Delhi Police uploads most FIRs on its website, so a copy can usually be obtained quickly for the bail application. Complaints in matrimonial disputes are often first referred to the Crime Against Women (CAW) Cell for counselling, which gives time to seek anticipatory bail.

Documents for a Bail Application

  • FIR or complaint: A copy of the FIR, notice or summons.
  • Identity and address: Aadhaar or other identity proof and address proof of the accused and surety.
  • Background: Details of earlier cases, if any, and documents supporting your version, such as agreements, chats or medical records.
