Adoption Law: Building Families with Legal Certainty
At Law Chambers of Mridul Jindal we assist prospective parents through the legal process of adoption in India, ensuring the child's rights are protected and the adoption is fully recognised under law. Our Advocates guide families through both the Hindu Adoption and Maintenance Act, 1956 route and the CARA (Central Adoption Resource Authority) process under the Juvenile Justice (Care and Protection of Children) Act, 2015 that applies to all other adoptions in India, regardless of religion.
Adoption under the Hindu Adoption and Maintenance Act, 1956: We advise Hindu, Buddhist, Jain, and Sikh families on the eligibility conditions, consent requirements, and documentation needed to complete a valid adoption under this Act, including execution of the adoption deed.
CARA-Regulated Adoptions: For adoptions governed by the Juvenile Justice Act, 2015 (applicable to all prospective parents, including inter-country adoptions), we assist with registration on the CARINGS portal, compliance with home study reports, and representation before the District Child Protection Unit or court where required.
Step-Parent and Relative Adoptions: We help step-parents and relatives navigate the specific legal requirements for adopting a child already part of the family unit.
Contested Adoptions and Legal Disputes: Where an adoption's validity is challenged, or where biological or adoptive parents' rights come into conflict, our Advocates represent clients before the family courts to resolve the dispute in accordance with law.
Restitution of Conjugal Rights & Judicial Separation: Options Short of Divorce
Not every marital dispute has to end in divorce. Indian family law provides two distinct remedies for couples who are estranged but not seeking an immediate legal end to the marriage. Our Advocates advise clients on whichever remedy fits their circumstances, under Sections 9 and 10 of the Hindu Marriage Act, 1955 (and the corresponding provisions of the Special Marriage Act, 1954).
Restitution of Conjugal Rights (Section 9): Where one spouse has withdrawn from the other's society without reasonable excuse, we assist the aggrieved spouse in filing a petition to restore cohabitation, and advise on the legal consequences of non-compliance with a decree.
Judicial Separation (Section 10): We advise clients who are not yet ready for divorce on judicial separation, a court-recognised living-apart arrangement that suspends marital obligations without dissolving the marriage, and that can later be relied upon as a ground for divorce if reconciliation does not occur.
Choosing the Right Remedy: Our Advocates help clients weigh restitution, judicial separation, and divorce against their specific circumstances, including the impact on maintenance, custody, and future divorce proceedings.
Frequently Asked Questions: Family Law
How long does a mutual consent divorce take in India?
Under Section 13B of the Hindu Marriage Act, a mutual consent divorce requires a minimum
statutory cooling-off period of 6 months from the first motion (which courts can waive in
appropriate cases), followed by the second motion, typically concluding within 6-18 months
depending on the court's schedule.
How is maintenance amount decided in India?
Courts consider the income and assets of both spouses, the standard of living during the
marriage, reasonable needs of the claimant, and the paying spouse's financial capacity.
Maintenance can be claimed under the Hindu Marriage Act, the Hindu Adoption and Maintenance
Act, Section 144 of the BNSS (formerly Section 125 CrPC), or the Protection of Women from
Domestic Violence Act, 2005, depending on the applicant's circumstances.
At what age can a child decide which parent to live with?
There is no fixed statutory age, but courts give increasing weight to a child's preference
as the child matures, generally placing significant weight on the wishes of a child above
9-10 years, while the child's best interest remains the court's paramount consideration at
every age.
Do live-in partners have legal rights in India?
Indian courts have recognised that a live-in relationship of a reasonably long duration,
resembling marriage, can entitle a woman to maintenance under the Protection of Women from
Domestic Violence Act, 2005, and children born from such relationships have inheritance
rights, though live-in partners do not have all the rights available to married spouses.
Who is eligible to adopt a child in India?
Under CARA norms, any prospective adoptive parent who is physically, mentally, and
financially capable, and not otherwise disqualified, may adopt, subject to age-difference
norms between the child and the adoptive parent(s) and other eligibility criteria specified
under the Adoption Regulations, 2022.
Can I get a protection order under the Domestic Violence Act without filing for divorce?
Yes. A protection order, residence order, or monetary relief under the Protection of Women
from Domestic Violence Act, 2005 can be sought independently of, and without necessarily
leading to, divorce or judicial separation proceedings.
